ABSTRACT: This study was conducted to know the role and function of education service of the
province of DIY after the validation of Law Number 32 Year of 2004 in the contex of
public service, to know the juridical barriers experienced by education service of the
province of DIY after the validation of Law Number 32 Year of 2004 in the contex of
public service, and to found some steps and efforts to solve the problems.
This study was included in the type of Doctrinal Research (Normative Legal
Research) performing to find juridical Inconcrito that was descriptive and properly
applied to complete a certain juridical problem.
The study results showed that the basic and intermediate educational services were
performed successfully based on the indicators of services such as follows: basic
educational services (Elementary and Junior High Schools) involving even
distribution and expansion of education, educational financing, service of educational
quality, school management, and school accreditation were performed completely.
The intermediate educational services (Senior and Vocational High Schools) and even
distribution and expansion of educational services were performed successfully;
educational financing and service of educational quality were conducted sufficiently;
school management was activated properly; and school accreditation was performed
completely.
This study concluded that the function of educational service of the province of
DIY could perform public service of basic and intermediate educational services.
Nevertheless, there were some juridical barriers in performing public service
according to Law Number 20 Year of 2003 such as some governmental regulations
concerned with the management of basic and intermediate educational services were
not yet established. In addition, it was not found local regulation of the province
concerned with the educational performance, therefore it was necessary to conduct
some juridical steps and efforts to cope with some barriers in public service,
especially in the basic and intermediate educational services: performing the function
of official service according to the authority referred to the relevant legislation (Law
Number 20 Year of 2003, Law Number 32 Year of 2004, Governmental Regulation
Number 20 Year of 2007, and Local Regulation of the Province of DIY Number 7
Year of 2007), and establishing immediately the draft of local regulation planning
concerned with the educational performance.
INTISARI: Tujuan Penelitian ini untuk mengetahui peranan dan fungsi Dinas
Pendidikan Propinsi DIY setelah berlakunya Undang-Undang Nomor 32 Tahun 2004
dalam Konteks Pelayanan Masyarakat, mengetahui kendala-kendala yuridis yang
dihadapi Dinas Pendidikan Propinsi DIY setelah berlakunya Undang-Undang Nomor
32 Tahun 2004 dalam Konteks Pelayanan Masyarakat serta menemukan langkahlangkah/
upaya-upaya yuridis dalam mengatasi
Jenis ini penelitian ini adalah jenis Doctrinal Reserach (Normative Legal
Research) yaitu berupaya menemukan hukum Inconcrito yang sesuai untuk
diterapkan guna menyelesaikan suatu permasalahan hukum tertentu dan bersifat
diskriptif (desciptive)
Hasil penelitian menunjukan layanan pendidikan dasar dan menengah sudah
dianggap berhasil, hal ini ditunjukan indikator-indikator layanan sebagai berikut :
Layanan Pendidikan Dasar (SD dan SMP) meliputi Pemerataan dan Perluasan
Pendidikan, Pembiayaan Pendidikan, Layanan Mutu Pendidikan, cukup memenuhi,
Managemen Sekolah cukup aktif dan Akreditasi Sekolah telah selesai dilaksanakan.
Layanan Pendidikan Menengah (SMA dan SMK) Pemerataan dan Perluasan
Pendidikan, dinyatakan berhasil, Pembiayaan Pendidikan dan Layanan Mutu
Pendidikan cukup memenuhi, Managemen Sekolah cukup aktif dan Akreditasi
Sekolah telah selesai dilaksanakan
Kesimpulan penelitian ini adalah Fungsi Dinas Pendidikan Propinsi DIY telah
mampu melaksanakan pelayanan masyarakat di bidang pendidikan dasar dan
menengah, namun demikian terdapat kendala-kendala yuridis dalam melaksanakan
pelayanan masyarakat sesuai UU Nomor 20 Tahun 2003 yaitu beberapa peraturan
pemerintah yang sampai saat ini belum di undangkan, tentang Pengelolaan
Pendidikan Dasar dan Pengelolaan Pendidikan Menengah. Disamping itu Peraturan
Daerah Provinsi tentang Penyelenggaraan Pendidikan belum ada, sehingga perlu
langkah-langkah/upaya-upaya yuridis dalam mengatasi kendala-kendala pelayanan
masyarakat dalam Bidang Pendidikan Dasar dan Menengah yaitu melaksanakan
fungsi Dinas sesuai dengan kewenangannya dengan mengacu pada peraturan
perundang-undangan yang relevan (UU Nomor 20 Tahun 2003, UU Nomor 32 Tahun
2004, PP Nomor 38 Tahun 2007 dan Perda Propinsi DIY Nomor 7 Tahun 2007) dan
segera menyusun Draf Rancangan Peraturan Daerah tentang Penyelenggaraan
Pendidikan.
